WELSMS Terms and Conditions
WELSMS — A product of Elevonix Limited
Effective Date: 20 August 2026
1. Introduction
These Terms and Conditions (“Terms”) govern access to and use of WELSMS (“WELSMS”, “Service”, “Platform”), a fast virtual number and SMS verification platform operated as a product of Elevonix Limited (“Elevonix”, “we”, “us”, or “our”).
WELSMS enables individuals and businesses to obtain virtual phone numbers, where available, and receive SMS messages such as OTPs and verification codes from supported online services. WELSMS may rely on third-party providers, APIs, telecommunications networks, infrastructure and other integrations to supply numbers and deliver SMS.
By creating an account, funding a wallet, purchasing a number, requesting an activation, using the API, or otherwise using WELSMS, you agree to these Terms.
2. Eligibility and Account
You must provide accurate and current information when creating an account and must keep your login credentials secure. You are responsible for activity conducted through your account.
You must be legally capable of entering into these Terms under the laws applicable to you. WELSMS may restrict or terminate accounts where information is false, fraudulent, abusive, or materially inconsistent with these Terms.
3. Service Description and Third-Party Providers
WELSMS is an intermediary technology platform. Some or all virtual numbers, SMS delivery, activation services, telecommunications capacity, APIs and related infrastructure may be supplied by independent third-party providers.
Because WELSMS depends on third-party integrations and external networks, availability, pricing, number lifespan, delivery speed, supported countries, supported services, SMS receipt, and whether a particular online platform accepts a number may change without notice.
WELSMS does not guarantee that every number will work with every website, application, social network, financial service, messaging service or other destination. References to services such as WhatsApp, Telegram, Instagram, Facebook or similar platforms do not constitute a guarantee of compatibility or successful verification.
4. Acceptable Use
You may use WELSMS only for lawful and legitimate purposes. You must comply with applicable laws, regulations, third-party platform rules and these Terms.
5. Prohibited Activities
- Fraud, scams, impersonation, identity theft or deceptive activity.
- Account takeover, credential theft, phishing or attempts to bypass security controls.
- Creating or operating accounts for unlawful activity or to evade bans, restrictions or enforcement measures.
- Use involving terrorism, money laundering, sanctions evasion, trafficking, exploitation or other serious unlawful conduct.
- Harassment, threats, abuse, spam or unlawful bulk messaging.
- Using WELSMS to facilitate unauthorized access to another person\'s account or systems.
- Attempting to interfere with, reverse engineer, overload, scrape, exploit or compromise the Platform or its third-party integrations.
- Reselling or sublicensing WELSMS access in a way that violates these Terms or applicable provider restrictions.
- Any activity prohibited by the laws applicable to you or by a relevant third-party platform.
6. Numbers, Activations and SMS
Virtual numbers are generally provided for the purpose and duration stated during purchase or activation. A number may be unavailable, withdrawn, recycled, reassigned, blocked, rejected by a destination service, or otherwise cease to function due to factors outside WELSMS\'s control.
SMS delivery is dependent on telecommunications networks, third-party providers and the originating service. A requested OTP or verification message may be delayed, fail to arrive, or be rejected.
You are responsible for using a number only for the supported service and period shown at purchase. Do not assume that a number gives you permanent ownership or exclusive rights to the underlying telephone number.
7. Wallet Funding and Payments
Where WELSMS provides wallet funding, funds credited to an account are intended for use on WELSMS services. Payment processing may be handled through third-party payment processors. A transaction may be delayed, declined, reversed, or placed under review by the payment provider or financial institution.
You must not use fraudulent, stolen, unauthorized or disputed payment methods. WELSMS may suspend access while investigating suspicious transactions.
8. Pricing and Changes
Prices, availability, supported countries, providers, services and fees may change at any time. The applicable price displayed at the time of a transaction is the price that ordinarily applies to that transaction, subject to payment processing, technical errors, provider changes, or correction of obvious pricing errors.
WELSMS may modify, suspend or discontinue any feature or integration where reasonably necessary, including because of third-party provider changes.
9. Refunds
All purchases and wallet funding are subject to the WELSMS Refund and Non-Refund Policy, which forms part of these Terms.
Unless expressly stated in that policy, payments are non-refundable. Where a specific service-level refund or automatic refund is offered for a qualifying failed activation, it applies only according to the conditions displayed by WELSMS at the time of purchase.
10. Intellectual Property
WELSMS, including its branding, software, interface, content, design, documentation and associated intellectual property, belongs to or is licensed to Elevonix Limited. Nothing in these Terms transfers ownership of WELSMS or its intellectual property to you.
You receive only a limited, revocable, non-exclusive and non-transferable right to use the Service in accordance with these Terms.
11. Privacy
Your use of WELSMS is also governed by the WELSMS Privacy Policy. By using the Platform, you acknowledge that information may be collected, processed, stored and shared as described in that policy, including where necessary with third-party service providers and integrations used to operate the Service.
12. Service Availability and Disclaimer
WELSMS is provided on an “as available” and “as is” basis to the extent permitted by law. We do not promise uninterrupted availability, universal compatibility, permanent number access, guaranteed SMS delivery, or successful verification on any particular third-party platform.
We are not responsible for failures caused by telecommunications networks, third-party providers, destination platforms, payment processors, internet outages, regulatory actions, provider restrictions, maintenance, force majeure, or circumstances beyond our reasonable control.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Elevonix Limited and WELSMS will not be liable for indirect, incidental, special, consequential or punitive losses, loss of profits, loss of business, loss of data, loss of account access, or losses arising from a third-party platform\'s refusal to accept a number.
Where liability cannot legally be excluded, our liability will be limited to the extent permitted by applicable law and, where appropriate, to the amount paid for the specific WELSMS transaction giving rise to the claim.
14. Suspension and Termination
We may suspend, restrict or terminate an account or transaction where we reasonably believe there is fraud, abuse, security risk, unlawful activity, violation of these Terms, payment irregularity, provider restriction, or other conduct that may expose WELSMS, Elevonix, users or third parties to harm.
Termination does not automatically create a right to a refund.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when published through WELSMS unless a different effective date is stated. Continued use of WELSMS after an update constitutes acceptance of the revised Terms, to the extent permitted by law.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria, subject to any mandatory legal protections that apply to you.
The parties should first attempt to resolve disputes through good-faith communication. Where a dispute cannot be resolved informally, it may be referred to the competent courts or another lawful dispute-resolution process applicable in Nigeria.
